The concept of animal welfare and animal protection has been firmly established as a result of the progress of human civilization and awareness of environmental protection. Moreover, with the gradual decline of traditional trade barriers, the new trade frictions caused by animal welfare are increasing. Therefore, a research on animal welfare barriers originating from legal system has a profound practical and theoretical significance.This article consists of four parts: The first part covers the overview of animal welfare including its legal content, development history and worldwide legislation from a macroscopic angle to show its progressive significance. The second part makes an analysis of animal welfare barriers. In which the particularity of this new-type trade barrier is illustrated by comparing with similar definition of barriers. Besides, to further explain the causes of barriers based on its barrier-specificity. The third part reviews the potential legal basis of animal welfare barriers in the WTO rules as well as possible application in the international trade. Furthermore, to point out the negative impact of international trade of China such as livestock, Chinese medicine and fur industry according to the recent exported cases studies. The fourth part assesses the status of current animal protection legislation of China. On the one hand this part focuses on the recent trend of China's animal protection legislation; on the other hand this part proposes the legal countermeasures in international law and domestic law.
