Intangible Cultural Heritage is an international concept; it has both cultural and historical significance, but also has legal significance. Under the auspices of UNESCO, cultural heritage protection began in the 80s of last century at the international level , at the beginning 10 years of this century, non-material cultural heritage protection in China started in general.Xinjiang has a long history and splendid culture, the various ethnic groups in Xinjiang, the long-term practice of the rich and varied life of the intangible cultural heritage. As the impact of modernization, market-oriented and foreign cultures, the Intangible Cultural Heritage of Ethnic Minorities is in the loss, a lot of valuable heritage is facing the situation as " skills extinguishing when people dying " "Song stopped when people dying " . law as an important means of protecting the orderly conduct, it is of great significance for Non-material cultural heritage protection. But now the local legislation has been introduced to non-material cultural heritage protection, some key issues needed to be solved, such as financial management is imperfect, successor protection of heritage is not enough, social participation is still no clear identification, the legislation has not been a corresponding system design. Therefore, the need to further improve the local system of legal protection for intangible cultural heritage is to response to the urgent need to resolve the problem.This paper tries to analyze the Intangible Cultural Heritage of Xinjiang, the local legislation and the practice, I want to start from the legislative issues in Xinjiang, to analysis of cause of the problem is to offer some suggestions. Therefore, this article can be divided into four parts: The first part describes the protection of intangible cultural heritage origin; The second part of the study and to compare domestic and foreign non-material cultural heritage protection system; The third part is form of legal protection of Xinjiang Intangible cultural heritage and conservation status of the analysis; The fourth part is the institutional recommendations, which improve the protection of Intangible Cultural Heritage of Ethnic Minorities in the concept of the system, including the development of special funds management practices, the establishment of protection mechanisms inheritors of a special protection for those heritage items, building production protection system and carry out protection of school education, in order to promote the protection of intangible cultural heritage for Xinjiang autonomous region and to provide reference.
