Studies Of The Application Of Security Class Action

At present, the number of Infrigement act in security market in China is increasing continuously, which infrige the interest of investors. The aim of civil action with regard to security is to make the best of legal mechanism to encourage those investors being torted win compensation, and thus mobilize the initiative of those small investors and institutional investors to join in the supervision in securtiy market, which will ensure the healthy development of the market.This paper try to discuss the practicability of the America Security Calss Action implementing in our country by analyse the history and effect of practice of security civil litigation.This paper is composed by four parts. The first chapter introduces the general principle of security class action, clarifying the confused condition of the concept of class action. The second chapter analyse present situation of security class action system in China, which is called litigation representative, and also point out the shortcoming of this system. The third chapter compare and analyse the America Security Class Action and the relative system in China. The last chapter discusses the practicability of the America Class Action system applied in our country and finally come to a conclusion that we may draw on some useful rules of America to make the litigation representative system produce a marked effect in solving the security dispute. Overall, this paper stand with the point that we should insist on the litigation representative system and adjust in a small degree, but no need to apply the America Security Class Action system completely.
