In recent years the legislature gradually take thelight punishment in tax-related criminal offenses, credit card fraud and other economic crimes .And certain types of financial crime have been designed with the system of"conditionality leaves the crime mechanism", This trend provides a new perspective of certain financial crimes for the Criminal Code . From the theoretical analysis, it also provides an opportunity for the detailed classification of crime: we may consider whether the benefits are actually been destruct , whether can be fully recovered and the policy of justice with Mercy , we can consider divides the crime into"the law profit recoverability crime"and the law profit not recoverability crime,which to agree with the judicial practice of"conditionality leaves the crime mechanism".From the issue of the nature during financial ,economic crime and other pure natural crime such as murder, injury, rape ,we can get the comparative analysis of those crime that financial ,economic crime destruct the benefits will more abstract and almost about the public benefits. Protection of public interest is one of the fundamental task of theCriminal Code. In comparison,"conditionality leaves the crime mechanism"will goes more longer. However, the"conditionality leaves the crime mechanism"must be properly set up the conflict with Accomplishment of Crime. From the evidence and legal interest standard,the theory of accomplishment Crime is essential ,but sometimes could be Irrational facing some financial and economic crimes. So It follows that"conditionality leaves the crime mechanism"applies to certain financial crimes,take it as a new, non-universal processing model of crime,It is foreseeable that it can merge with the traditional evaluation model .
