| TV shopping is a new way of sale. The market in this field in China has reached 23.4 billion in 2009.TV Shopping has its own unique advantages over the other ways of sale. The potential of purchase of the consumers is fully tapped through this way in which videos, illustrations and instructions are employed. In the meanwhile however, due to the fact that TV shopping dealings are not done on genuine shops, which means that commodities are always delivered to the customers through logistics, rapid development in this area brings huge problems, among which defraud and false advertisements are instances.This paper makes a deep legal analysis on TV shopping. Then based on the Law of the People's Republic of China on Protection of Consumer Rights and Interests,Anti-Unfair Competition Law of the People's Republic of China, Administrative Measures for the Broadcasting of Radio and TV Advertisement and the like,and together with my own research, I try to make it clear how to protect the consumer, who are always in a disadvantageous position. In the final place, the paper goes with civil liabilities may possibly be incurred by the broadcasters and presents some suggestions in a view of economical law. The content is composed of three aspects: the first is the analysis of TV shopping advertisements. Through the TV shopping advertisements' characteristic, I make an analysis on new features of consumer rights, and then makes an analysis on broadcasters'liabilities for the rise of false advertisements of TV shopping; the second is the protection of consumer rights in the light of economic law and civil law, and then is the present situation of legal rules and regulations on false advertisements of TV shopping; the third part puts forward my recommendations about how to build a TV shopping legal system that takes consumer protection as its core. |
