Our country's court mediation system is an important institution in civil procedure, which plays an important role in solving civil disputes. Recently, as the concepts of building Socialist harmonious society and building harmonious justice are raised, court mediation play an increasingly irreplaced role in solving civil disputes and contradictions. With the continuely development of market economy and the change of judicial policy, court mediation system is widely used in judicial practice. With the increasingly rate of ending the lawsuits by court mediation, we must realize a serious problem that court mediation is excessively used in judicial practice. This paper will analyse the current situation of our court mediation and the difference between our country's court mediation and the other's court mediation. There are four parts in this article.The first chapter mainly introduce the definition and the characters of the court mediation, find the difference between the court mediation and the related concepts. In this section, it also summarizes the nature,functions and the value of court mediation.The second chapter compares the court mediation system between other courties and the district of Taiwan. By finding the similar and difference between these areas, advanced experience will be taken example by the reform of our country's court mediation system.The third chapter describes the current court system in China from the angles of legislative and judicial practice, and analysed the problems that our court faced.The fourth chapter analyze the main view on the reformation of our court mediation system. In this section, I put forward my imagination of reconstructing our court mediation system.
