Court mediation system is an important system of civil action in china, which plays an important role in the civil trial. With the continued development of market economy and gradual improvement of the legal system, court mediation system is also facing challenges of the new social environment and ideas. In recent years, It is one of hot topics in the Civil Trial Reform to reform the court mediation system. There still exists great dispute on which how should reform and develop the court mediation system in legal theorists. In this article, we have known how court mediation is playing its role in calming the dispute in the long course of history through analysis development of court mediation from the ancient to the modern. By analyzing the nature and function of the court mediation, we have seen it plays an irreplaceable role in modern society. Then by comparison and analysis with related foreign systems, it is helpful for us to find insufficiency in court mediation, so as to provide valuable experience for reference. Finally, through the analysis of current situation and problems of the Court Mediation, it further indicates how necessary and urgent to perfect the Court Mediation System. In the last part of the article the author have a brief analysis of how to improve our court mediation system.
