Research On The System Of Advance Notice Registration

Since the implementation of "Real Right Law", it has played a huge role in the maintenance of our economic system and economic order, bringing into play the effectiveness of res and protecting the rights of right owner. However, some system established by the "Real Right Law" did not play its due role in the implementation process owning to a variety of reasons. Advance notice registration is one of the typical systems. Advance notice registration system is an important real right law system, its important role is reflected in maintaining the market credit, protecting security of transactions and the rights of the parties and so on. Although China's advance notice registration system draws on the experience of foreign legislation and combined with China's national conditions, however, during the implementation process of the notice registration system, because of the letters of the law are not enough detailed, registration authorities are not unified, laws and regulations are fragmentation, resulting in the notice registration system difficult to implement smoothly and play its positive role. So how to improve the notice of the registration system should be strengthened to meet the needs of social reality.This article is divided into four main parts:The first part is an overview of the advance notice registration system. This part start from the concept of registration system, make the overall introduce of advance notice registration system, including its nature, theoretical and practical significance, and the differences with other related concepts. This part provides a basis for later discussion.The second part is the theory of notice registration system. This part research on apply scope and effectiveness of the advance notice registration system, by summing up the different theories of the registration system, analyzed the deficiencies of scope and effectiveness of the advance notice registration.The third part is the status and problems of advance notice registration system. This part made a detailed analysis of status and the problems encountered in the implementation process of advance notice registration, including the limitations of activation mechanism, there is no unified real estate registration law and real Registration authority, the applicant of registration is not clearly defined and so on.The fourth part is the improvement of advance notice registration system, through the analysis of problems exist the advance notice registration system in the second and third part of the article, put forward specific measures from two major aspects:improve the letter of "Real Right Law" and unify the management authorities of real estate registration.
