More than 80% of international trade has been done by sea transportation. In 2009, China became the biggest exporter by exceeding Germany. Since then, the import and export trade in China ran into an active period. The main goods of exporter are mostly medium and small ones in China cause its special policy or national conditions. Which means most of the international trading will be done by FOB price terms. The Maritime Law in China still has space to improve in protecting the right of exporter.Documentary shipper is a new conception that set up by The Rotterdam Rules. The main purpose of this term is to protect the seller in FOB price terms and to provide a specific legal ground to solve the dispute rising from the indistinct part of international convention. Therefore this paper will discuss the influence of Documentary shipper institution in The Rotterdam Rules to native seller under FOB on the base of the conception, rights and obligations of Documentary shipper. Reconceive if the shipper item in Maritime Law in China be appropriate for the development of modern international trade in goods and absorb the reasonable part of The Rotterdam Rules to give advice on editing of Maritime Law in China.
