Since reform and opening, along with the rapid development of China's national economy, petrochemical and related industries also developed rapidly, China's demand for oil increased year by year, As the offshore oil transport dramatically increased, the number of ship oil spilling is growing.However, China's oil spilling accidents happened a lot, cleaning up is poor, and there is no corresponding emergency response mechanism, also there is no complete and effective marine oil pollution damage compensation fund legal system. For this reason, this paper attempts to analyze the characteristics of the establishment of China's oil Damages foundation:from the comparison of three present international oil pollution compensation funds to the legal characteristics of Ship Oil Pollution Compensation Fund and finally presents comments and suggestions of how to improve and China's Oil Pollution Compensation Fund. Given China's current situation and the actual oil pollution damage in China's economic level, fully joining the Fund Convention is not mature, and the establishment the Oil Pollution Compensation Fund with Chinese characteristic is more reasonable, through management and operation, Experience is accumulated to prepare for accession to international conventions for the future.This is also a detailed study of a few difficult problems of current oil pollution compensation fund, such as, the scope of pollution damage in the vessel, emergency response mechanisms, pure economic losses. Compared with other countries or international treaties, present the principles and methods when the court deal with these cases, and give recommendations and advice to the legislature, judiciary and academic circles for reference.
