Study On Censorship Of Local Administrative Legislation

The local administrative legislation is an important part of China's legislative system, it plays a unique role in the construction of legal system in China, but an effective legislation review hasn't established. Legislation review is a important way to uphold the constitution and the authority of law and protect citizens' rights.This paper points out the legislation review of administrative legislation in our current country, exist such as review subject setting chaos, censorship standards broad, review procedures missing defects, can't effectively review local administrative legislation. Then from the nature of administrative legislation, administrative behavior and judicial examination and the relationship between the properties of discussed legislative investigation of local administrative legislation, analyses the reasons for the deficiency in the system of examination. This paper also introduces the legislation review of Britain, the United States, France and Germany, and point out the place worthing us for reference.On this basis, this paper mainly discusses the way to perfect the system of local administrative legislation review. Entity subject setting, examination standard and authority, examination approach, which include legislative and administrative organs of local administrative legislation of the review, and necessary to build judicial review. On the program, program of local administrative legislation, review procedures for the initiation, accept and examine, examination results were expounded.
