Study On The System Of Prosecutorial Supervision Of Civil Execution

Without supervision power will move towards corruption. The increasing phenomena of executive difficulty, executive non-conformity and consequent problems warn the people frequently that any power must be exercised under the supervision. There are several factors in these phenomena in judicial practice. Lacking of effective supervision is the most important factor. In our opinion, the improvement of the system of prosecutorial supervision of civil execution can solve the problem effectively according to the current situation in China. The superintendence must be defined clearly both in legislation and judicial practice. The system of prosecutorial supervision of civil execution should be improved with the development of the judicial practice.The thesis includes three parts:introduction, main body and conclusion. There are four chapters in the main body. The thesis is fibered by introducing a question, covering the subject and solving the problem. All the discussions focus on the system of prosecutorial supervision of civil execution.The main body can be divided into four chapters. The subject of the thesis is introduced in the first chapter, within which the system of prosecutorial supervision of civil execution analyzed, covered and defined. Then the chapter further analyzed the conception, features and the possible results in details. In chapter two, the necessity of improvement of the system of prosecutorial supervision is illustrated. Improving the system of prosecutorial supervision is the only way to solve the problem in execution. In the future, the system-improving process is an inevitable trend both in legislation and judicial practice, for it has a very strong practical feasibility. In the third chapter, the current problem in judicial practice of the system is advanced, at the same time, a few positive trials are displayed in this chapter. In the last chapter, the thesis gave some legislative proposals on legislation and judicial practice aiming at the existing problems of system of prosecutorial supervision of civil execution. The legislative proposals are very feasible and significant.The thesis is based on both the social reality and law theoretical outcomes. Some study methods are used in the thesis such as comparative research method, logical analysis method, and historical analysis method. The current situation, the reasons, the countermeasures, the theory and procedure design are studied in the thesis.
