The Status Of Lawyers In Criminal Procedure

The social turmoil brought about by LiZhuang case has subsided, the lawyers still be in the process of the rule of law about China constantly pursuing the fairness and justice,and still play the role of the spokesperson for the rights of citizens, at the same time, also have to have more in-depth thinking about criminal judicial system of China. the status of Lawyers in criminal lawsuit, marked the maturity of criminal defense system, and is a miniature of the process of the rule of law in our country. The criminal defense system is an important system in criminal lawsuit activity, it is linked to the criminal suspects, defendants' vital interests, and it is closely related to the construction of the rule of law in our country, and is an important symbol of the civilization of legal system and human rights, nowadays, in order to fully guarantee the criminal suspect, the defendant's legitimate rights and interests, and to realize the pursuit of truth and justice goals and give lawyers full anairport, which is practiced in the world. However, the status of lawers in criminal lawsuit activity still be very worrying, the equality between accuser and defender, and the litigation mode of referee centring still be a kind of ideal.Thoroughly understanding the above problems, this paper on the basis of the case about which LiZhuang committed to forge evidence and hamper testifying, through an earnest thinking about the part of the legal issues involved, which reflect the status of lawyers of China in criminal procedure. This paper points to three parts:first,I outlined the focus of this case,and list in detail the reasons on the dispute of the parties. Second, on the basis of commenting the reasons on disputes of parties, I proposed own idea. Finally,I thought the countermeasures against related issues. Among them, the second part and the third part are the key part of articles. Eventually I want to explain the status of lawyers in our state,and hope that it has little effect for criminal lawyers fighting for loose practice environment in our country, and helps the proceeding of the rule of law of China.
