Offense of extorting a confession by torture is a criminal offense which seriously infringes upon the rights of the person of citizens and undermines judicial organ's prestige. With the enforcement of revised criminal law, there still exist some controversies concerned with the ascertainment of the offense, for instance, the target of crime, the subject of crime, the prescription of body injuries as offense of transformation, which demonstrate different understandings in legal theories and practices. This thesis intends to put forward the legislative suggestions to perfect the offense of extorting a confession by torture from the point of the offense's historic development, the ascertainment of the target of crime, the subject of crime, and the recognition of body injuries as consequentially worsened offense.
