An Analysis On Issues Of China's Public Donation

Public donation is the way of calling the society to donor to the recipients who should be helped. It notices in order to arouse the public's concern and sympathy. This phenomenon is very common in our daily life, but the relevant laws and regulations are complex, fragmented and chaotic, resulting in many disputes. it damages people's enthusiasm, so the public donation need to be legal researched.This paper gives a detailed analysis of a case about the public donation balance disputes and combs the social collection behavior properties theory. It advances the operating methods in judicatory practice, and I would like to call on that we should establish our social collection system in legislation.Thesis comprises three parts. Part one:The case description. This section mainly explains the case, the situation of ruling case, the dispute question of the case. Part two:Analysis the dispute question of the case. This section mainly analyzes the properties of the social collection behavior, the ownership of donation balance and comments the situation of ruling the case. Besides, this section also analyzes the situation that the plaintiff called whether the debt pay from donation balance. Part three:Reflections from the case. This section analyzes the existing problems about our social collection and legislative proposals, and put forward the suggestions of the judicial practice in dealing with such cases.
