The Construction Of The Non-public Charitable Donation Legal System In China

After the implementation of the reform and opening-up in China, the nationaleconomy has rapid development, and the level of people’s life has great enhancement, thatmakes charities in our country have great development, and non-public charitabledonation plays a more and more important role in it. Especially in recent years, sorts ofserious natural disasters occurred frequently, non-public charitable donation was carriedout more and more, that shows it s important role in disaster relief. However, because ourcountry has no legal regulations on non-public charitable donation, the disputes orlitigation about non-public charitable donation are more and more. This has seriouslyaffected the carry out of non-public charitable donation, if these problems are not solvedin time, will restrict the development of charities.The present research of the charitable donation are mainly focus on public charitabledonation, and the research on public charitable donation has been more and more mature,the legislation about public charitable donation also perfect relatively. Just on the contrary,also as an important part of the charitable donation, non-public charitable donation notonly in the legislation is blank, but also not obtained the attention of scholars in the theory.This article is in this background, starting from the concept and characteristics ofnon-public charitable donation, research on the legal system of non-public charitabledonation, and then put forward my suggestion about the construction of non-publiccharitable donation legal system. First of all, starts from China’s first "love case in theintroduction part, detailed introduce the case, and simply introduces the research status athome and abroad. In the first part of the article, analyzes the concept and characteristics ofnon-public charitable donation, and on this base analyzes the attribute of non-publiccharitable donation to put forward my own view, this is the focus o f this paper, also thedifficulty; the second part of the article analyzes China’s main problems existing innon-public charitable donation; the last part of the article is for the questions mentioned inthe second part, put forward my suggestion about the construction of non-public charitabledonation legal system,this part is the purpose of writing this article.
