In modern society,Knowledge structure become more and more professional. Entering into any professional filed needs to master specific knowledge and skills. Based on their limited knowledge, ability and close professional division, people treat experts with more trust and expectation when they are dealing with affairs. The possibility of abuse of trust also increase. Then experts'Civil liability generate. Experts'Civil liability of lawyer is one of the experts'responsibility. Now there is a basic prototype of lawyers'professional liability system in China. But there are still many defects in some relevant provision. For example, Inconsistencies in legislation, part of the problem have not been clearly defined, and the general theory related have not been fully explained and demonstrated thoroughly. Many problems in practice also generate. The protection of the interests of the client or third person is particularly prominent in the present context. Many countries seek out damage of relief through various forms and play a very good performance. Therefore it is worthy of our reference. In particular, the practice of limiting or transferring risk not only protect the legitimate rights and interests, but also maintain professional enthusiasm of lawyers. It promotes the overall development of the legal profession, and in order to the best interests of all parties. This article draws judicial experience and the basic theory related in the two legal systems and bases on older research, in order to obtain more detailed research and analysis on this issue. Looking forward to be benefit for establishing of experts'Civil liability of lawyer.
