The organised crime has been established for a long time, but the theoretical research of it has been not established until now. Actually, The scope of organised crime and the related law haven't been solved yet.The first chapter of the essay is to analyse and discuss the situation about the Scope of organised crime, including the situation of this before 1997, the Criminal law to set the eatablished range of it in 1997, and the current situation of this aspact from 1997 to now.The second chapter is based on the first one and also to do a farther study about the Scope of organised crime in China, inculding the analysis of the shortcomings of the Current regulations about the Scope of organised crime, the practice analysis of established range of this,the theoretical analysis of this,and comparative analysis from other countries and international criminal law. Through all of these,we found that it is not adapt to punish the organised crime through current regulations of this scope and surely, not fit the development of theoretical analysis and international criminal law.Based on the above chapters, the third chapter puts forward the view(the needed expand of the scope of organised crime in our nation),and has a detailed discussion to how to expand it. It points out the key factor to influence the scope of organised crime and the specific standard of this scope in our nation, in addtion, this chapter also points out its own view to take crimes defined as organised crimes, such as computer Crimes, malfeasance crimes and other five kinds of crimes should be included into this scope.Then,it explains the theory and practical basis why these seven kinds of crimes should be conclouded into this in detail. Thus, try to solve some theoretical and practical problems of organised crime, and make it possible to supply reference to complete the criminal legislation about organised crimes in our country.
