This thesis consists of three pans,Introduction,Body and Conclusion.The body is divided into three chapters.The Introduction describes the serious situation of the current road traffic safety,the legislation situation of the Traffic Accident Crime,the significance of the topic and paper structure.As a multiple and common fault of the crime of endangering public safety,the Traffic Accident Crime can cause very serious consequences.In order to effectively prevent and control the occurrence of criminal cases of traffic accident,existing Criminal law penalties for crimes of causing traffic casualties in China has detailed provisions,and also has different penalties for different circumstances.The Supreme People'S Couft issued the judicial explanation,which plays a strong role in guiding trials on Traffic Accident Crime.At present,there are lots of work on traffic crime,mainly focus on the certification of subject of the Traffic Accident Crime,hit—and—run,surrender,drunken driving and SO on,but there are great different opinions in these researches.In judicial practice,due to the complexity of the behavior of traffic accident,the identification and treatment of different regions are not consistent in the same plot.It is a positive significance to study the subject for cri minal law theory and judicial practice. The first chapter studies on traffic crime subjects,analyzing the nature,content and scope of the Traffic Accident Crime subjects.According to relevant provisions of the existing Criminal law and the"judicial explanation",the main general subjects Traffic Accident Crime should include transport staff and non—transport personnel, drivers of motor vehicles,non—motorized vehicle drivers,pedestrians,passengers and transport units can be the subjects of Traffic Accident Crime.The second chapter is dedicated tO the research on hit—and-run accident, analyzing the meaning and constituents of the hit—and-run accident , the implication, legal character and crime forms of the"Death by hit-and—run",and especially parsing the crime forms of the"Death by hit-and-run".The third chapter focuses on the issue of Traffic Accident Crime surrender. Through analysis,it comes tO a conclusion that the Traffic Accident Crime applies tO surrender system,and summarizing the plot identification of the Traffic Accident Crime surrender.Because of the complexity of the Traffic Accident Crime,there are many differences criminal law and judicial practice,we need more tO research and discuss these issues.Basing on existing research results,combining with the relevant legislation and judicial interpretation of traffic accident,initiating from a large number of traffic accidents criminal cases,the author analyzes and tests the identification of the Traffic Accident Crime subjects,hit—and—run,surrendeL and finally puts forward ideas about perfection of the Law.
