Research On Several Problems In The Crime Of Causing Traffic Casualties

With the rapid development of society and economy,road traffic is becoming more and more busy.Meanwhile,traffic accidents happen almost every day,every moment.Traffic accident crime is also a high incidence of frequent occurrence,seriously affecting the normal order of life of the people.The author as a just engaged in traffic management work for one year at the grassroots level traffic police brigade cadres,in daily work and judicial practice,it is inevitable to encounter some difficult problems of traffic accident crime,and seem to be at a loss what to do.Therefore,the author through the access to information,literature,and combined with a number of traffic accident crime typical cases and actual situation,these difficulties are analyzed and studied one by one,and my own views are put forward.In this way,in improving my practical work ability at the same time,for traffic management work to provide some reference.This article is divided into four parts.In the first chapter,through the comparative analysis of the traffic accidents and traffic accident crime in the administrative area of the author,the characteristics of the traffic accident crime are presented.To investigate and investigate the traffic police at the grassroots level,and to look for the change and development of the traffic police cases handled by the public security traffic police departments.Finally,puts forward the difficulties and problems in the crime of causing traffic casualties.The second chapter of the traffic accident and traffic accident are distinguished from criminal responsibility,responsibility,subjective and objective meaning and special situation four aspects different from the relationship between traffic accidentliability and traffic accident crime and criminal responsibility,criminal responsibility of traffic accident crime identification are summarized.The third chapter studies the surrender of traffic accident crime.On the essence of surrender is analyzed,analyzes whether the traffic accident crime for the surrender of the system of traffic accident crime dispute,must apply to surrender system,and "Opinions on Several Issues concerning Surrender and meritorious service" as stipulated in the "regarded as voluntary surrender" describes the author's understanding and views.The fourth chapter studies the related problems of escaping after traffic accident.This paper analyzes the meaning and constitutive requirements of escaping after traffic accident,expounds the meaning and form of crime caused by escaping death,and analyzes several kinds of culpability caused by escaping death.Traffic accident crime is more common in judicial practice,but there are many differences in theory and judicial practice because of the complexity and complexity of the actual case.hrough the analysis of the existing research results,combined with a typical case and the actual situation,from the above four parts of some difficult problems of traffic accident crime research,to identify the traffic accident crime in the judicial practice to provide some help.
