China has now formed a legal system for the protection workers of mining enterprise. However, these laws and regulations have not been well implemented. The rights and interests of the workers of mining enterprise encroached a lot it's hard to remedy well. The successful experience of developed countries like the United States and Australia in the protection of labor rights and interests of mining enterprises is their complete sound laws and regulations, strict government supervision and management system, sound corporate training systems and a good production environment, highly developed building trade unions and so on. Therefore, To address the situations of the Industry self-regulation has not been established in mining enterprises, administration regulatory approach is not yet mature, and low quality of a sense of law of the workers, the following recommendations are on the improvement of mining enterprises on the protection of labor rights:At first, to enhance cultural, technical education and training to improve the overall quality of workers of mining enterprises; at second, to improvement of the existing laws and regulations to enhance the operability; thirdly, to strength the administrative supervision; and at last, the improvement of the legal relief of the workers affected is important.
