Research On The Protection Of Workers’ Rights And Interests In The Case Of Enterprise Bankruptcy

With the development of socialist market economy,competition environment makes part of the enterprise bankruptcy is inevitable,and for working-class people,wage income is the main source of a family,after the bankruptcy is directly affected by the employees and their families behind,serious or even affect their survival.Therefore,the protection of workers of bankrupt enterprises have become the focus in enterprise bankruptcy,but the current protection of workers’ rights system has some defects,leading to frequent violations of workers rights cases,need to study the system and find out the deficiency to be perfect.With the implementation of the new bankruptcy law as the basis,analyze the basic data on the current situation of protection of workers’ rights system in China,using the methods of literature research,empirical research,comparative research,summed up the guarantee debts over the absolute priority,the internal staff claims priority is not clear,the problem of social security disputes and the settlement scheme is difficult to implement and workers to attend the creditors’ meeting shall not have voting rights and other issues.Through this analysis provisions on the protection of the rights of workers abroad in the bankruptcy law and the foreign scholars,combined with China’s national conditions,proposed the establishment of the fund,to ensure the implementation of resettlement plan,improve the social insurance system,clear the rights of the representatives of the staff and workers with ideas.
