The Study On Laborer's Privacy Right

Laborer's Privacy Right is the specific performance of Right to Privacy reflected in the labor relationships. It means laborers can enjoy the peace of personal lives and the protection of personal information when in labor relationships. As one important right of Laborer's Individual Rights, it shows the legal value of human dignity and individual freedom and thus it shall be protected by law.There are almost no rules in our labor legislation to protect Laborer's Privacy Right. It's certainly not conducive to the protection of employee's privacy. Our labor legislation lacks the guiding principles of protection, the specific scope of rights protected and the corresponding remedies. The thesis tries to propose some suggestions to improve the protection status of Laborer's Privacy Right in our labor legislation, by referring to corresponding foreign legislations, overseas judicatory practice and the actual state of our country.The last part of the thesis proposes three suggestions, including constructing the legal principles of the protection of Laborer's Privacy Right, clarifying the scope of rights that can be protected and restricted, building the corresponding remedies of Laborer's Privacy Right. If these suggestions could do any benefits to the improvement of our labor legislation, the original intention of the thesis has been achieved.
