The labor forms become flexible and diverse due to the fast development of society,which means it is difficult to distinguish labor relations from other forms of labor.The emergence of a large number of new types of employment relations also increases the difficulty of establishing standards for labor relations,such as how to make sure the labor relations of interns who still are students,how to identify the labor relations of retired people who are hired back to work,and people who provide housekeeping service.Situations like these need clearer definitions about different labor relations,which will promote labor law to have more specific details and standards.New forms of employment impact strongly on traditional ways of labor,these problems cannot just rely on the existing standards of labor relations.People do research to find out whether the traditional labor relations still work for new situations and protect labor's legal rights.Currently,China does not have clear definitions of labor relations and the distinction of subject of labor relations.Meanwhile,lacking theoretical research lead to unpredictability in using labor relations and different standards used by local courts.It is inevitable to solve labor disputes with recognizing labor relations,it also is of great significance for the development of labor law and labor law practice.In order to make the standards of recognizing labor relations adapt to the current new labor forms and the economic and social development,this article introduces and analyses experiences of developed countries in this field,which supports my suggestions including the definition of labor relations,how to explain the subject of labor relations to promote the development of labor relations.
