Study On Bringing In Usufruct Of Farmland

As urbanization goes on, conflicts relating to land-ownership increase around China. People who refuse to remove kind of block the way of city construction, but tearing down their houses without permission violates their ownership, especially peasants who lost their land deserve public attention and solicitude from the legists. The author attempts to speak for the protection of the collective ownership of land. By analysis of legal principles and legality building, the author suggests to reform the organization of the performer of the collective ownership of land and to make it partially civil subject.This article concludes three parts:a foreword, two chapters and an ending. The foreword begins with the analysis of the current status of protection of land-ownership, and then explains the reason and value of the study. Besides, this part also states the present situation about this study in the law circle and gives a general description, legislation and the theory study about this topic. The first chapter analyzes how the system of protection of collective ownership of village land work in real world and what problems there are in this particular area and why these problems arise. The third and fourth chapter gives some advices on perfecting the legal provision by pulling-in usufruct of farmland and how to avoid problems arising from this new concept. And the ending sums up the whole study work of this article.
