The Legal Research On The Ownership Confirmation Of Collective Land

With the rapid development of economy and the acceleration of urban-rural integration,construction land demand is also on the rise year by year,thereupon the contradictions between people and land and land disputes are constantly emerging.So it is of vital importance to identify the ownership of the rights about the rural collective land confronted with such a situation.The work of land ownership confirmation of the rural collective land not only accords with the overall thinking of rural development but also lays a solid foundation for the reasonable and orderly circulation of rural land.Effective confirmation and authentic certification are critical factors to the maintenance of the legitimate land rights and interests of farmers,to the improvement of the basic rural operation system and the promotion of the overall development of urban and rural areas.Since 2010 the Central First Document has successively mentioned the confirmation,certification and registration of rural collective land,which indicates the direction for deepening the land reform.Based on the Property Law and combined with Provisional Regulations on Registration of Real Estate and a series of relevant policies issued by the government,this paper has established the land rights system from the perspective of law including the rural collective land ownership,the rural collective land usufructuary right and the rural collective land real rights for security.All this forms the rural collective land ownership confirmation system which is structurally complete,well-organized well-arranged.In the meanwhile,it has studied the legal matters involved in the certification process of the rights such as the rural collective land ownership,and the solutions have also been proposed accordingly to promote the work of ownership confirmation being carried out smoothly to form the right system with distinct property,clear power,good guarantee of rights and interests,free transferring and reasonable allocations in the ownership confirmation of the rural collective land,which can provide legal service for the ownership confirmation of the rural collective land and protection of farmers' rights and interests.
