| The war cannot be averted completly in the politically competition of contemporary international world. Under the circumstances, prisoner of war as the experiencer and bearer of the sufferings is very necessary to be protected by all of the world ,so that prisoner of war won't be into the worse condition .Therefore ,this thesis is divided to three parts in order to further know and inprove the legal system of prisoner of war.The first part:First a definition for prisoner of war is defined in order to clear who can enjoy treatment of prisoners,and the definition of war criminals, spyware and mercenaries that there are the relevant with identification to the prisoner of war are briefly analyzed.So it helps to establish prisoner'identity in the reality. Then it reviews the development history,it can be seen clearly that the development of the treatment of prisoners is to fallow the history of international society and the development of the prisoner with the concept of humanity. It also proves prisoners were included in the treatment of international humanitarian reasons. Finally,it analyzed prisoners of war for the protection of reason from the humanitarian and justice .The second part:According to logical sequence, it expatiated ordinally the indemnificatory rule of prisoners'identification, the rights of captured prisoners, repatriating prisoners of war etc mainly basing on the treatment of prisoners in 1949 the Geneva convention and the protocol additional to the provisions of the ruling status of prisoners .The third part:According to Preliminaries'analysis, it protection the short of the treatment of prisoners in the humanitarian protection of prisoners, and puts forward some feasible Suggestions in order to better protect the prisoners.Overall,this paper based on the existing provisions for prisoners of protection, clear the specific provisions and the treatment of prisoners of war, and execute from reality to its deficiency, make prisoners can guarantee rights. |
