The world's first case of organ transplantation was completed in the United States in 1954.And since then, as the development of organ transplant the cause of organ transplant has made great development. At the same time, it but also brought about to the tens of thousands of patients the new life. In the early 1960s, the first case of organ transplants in china conducted by the Professor Wu Jie Ping, was finished, but until now the whole organ transplantation was still less developed. The main cause is the shortage of organ of donors, which severely constrains the further development of organ transplant. According to statistics, there are about annually 300 million people who need kidney transplants and 100 million patients need bone marrow transplants for leukemia in the word. The total needs of Organ transplant of china has reached second in the world now, while only about 1 million people each year can have chance to accept organ transplant surgery. The origin shortage of organ of donor has seriously hindered the development of organ transplantation in China.How to safeguard the source of donor organ is an extremely complex project, it involves many areas such as legal, human ethics. In this case, the development of regulations and ethics are very important. The shortage of organ of origin and the lack of relevant laws and regulations is urgent problems in the field of organ transplantation in China. The paper mainly discusses how this matter can be safeguarded for the organ of donor supply.The article is divided into four parts, the first part explains of the organ donors in the legal level of understanding. As an organ donor mean, it is the object of the right of person, or property of the object; the second part analysis the source of organ and why it is lawful in our country. Now china has two main sources for the organ, one is from living donation; the second is from the death body; the third part emphasize the importance of donor origin and analysis the cause of shortage of organ as to suggest the law how to make better . The fourth elaborate suggestion to improve the protection of the donor organ in many ways through the above analysis, for example, the young people under 18 ages also an donate under specially restricted condition, the law should establish the standard cerebral death.
