The Development And Influence Of Constitutional Thought Of Ancient Greece And Rome

Constitutionalism as a political concept is the generally accepted in contemporary international society and is also a mature and rational political system. It's mainly from western contemporary constitutional thought, and refers to the source of western constitutional thought. We will have to trace back to ancient Greek and Roman times.In the article structure, the paper is divided into four chapters. Introduction describes some of the major domestic and international research review, the constitutional definition, research contents and methods, the meanings and shortcomings. The first three chapters are mainly in chronological order, the study of ancient Greece, Hellenistic, Roman ideas of constitutional development process; in the constitutional ideology, the Hellenistic period of ancient Greece's constitutional thought has inherited, development, Roman Period of ancient Greece, the Hellenistic period of constitutional thought has inherited, but also development. Chapter IV describes the constitutional period of ancient Greece and Rome to Western thought of modern constitutional thought and the significance in China. Constitutional Thought ancient Greece and Rome on western modern constitutional thought has an important influence, the impact on the one hand the impact of a constitutional element; the other hand, modern Western thought of ancient Greece and Rome orthodox constitutional succession. But because China and the West in history, civilization, customs, and so different, so how to use Western constitutional thought in our country's constitutional practice has always been a problem as well as the shortcomings of this article.The order, the legal system, democracy and equality ideology of ancient Greece; the individual, world countries, and contract theory of Hellenistic period; the mixed system of government, legal equality theory of Roman period promote the breeding of western constitutional thought and play an important role in the development of the West the formation of constitutional thought and the whole system of Western political thought. The constitutional ideas of Ancient Greece and Rome had a profound impact of the constitutional thought in the modern western development. The Renaissance and the Enlightenment, two major ideological movements, have a deep impulse to the modern constitutional thought. Thinkers find, explore and study many thoughts in ancient Greece and Rome. In politically, the primarily thought is the ideology of democracy, rule of law, separation of powers, the equality and freedom. Gifted thinkers have constructed in the modern sense ideologically democratic constitutional state, and thus in practice to create the United Kingdom, France, the U.S. constitutional system and other advanced countries. This is the ancient Greek and Roman elements in the modern sense of constitutional thought. From the Chinese perspective, China's major western idea is the introduction of modern constitutional thought. According to Chinese tradition and national conditions to develop the constitutional state system with Chinese characteristics is right, but only to introduce the western constitutional ideas rather than to find the origin of western constitutional ideas and seeds of such research is not enough, after all, is not profound. Therefore, to trace the source of western constitutional thought, and the original meaning of constitutional thought and combine them with national conditions and modernization of China's traditional requirements, meanwhile to learn from experience and construct the constitutional system of socialism with Chinese characteristics can let the development of the constitutional system sustainable.
