Modernization is the synthetic changing of society including economy, politics, culture psychology and national customs. Different form the modernization way of western countries, at the very beginning, the modernization possession of China was closed with the establishment of National Country form the reformation in late period of Qing Dynasty. So China couldn't enforce the movement of constitutionalism logically right after the establishment of National Country. That somehow made the modernization possession of China have its special feature and means. Open door and reformation policy whose main characteristic is to "divide power and give benefits" has become the engine with the reformation of social market and economy system to enforce the construction of constitutionalism of modern China. Making constitutionalism a symbol, politic modernization has become another epoch task after economic developing. But, "China has constitution for nearly a hundred years while the constitutionalism is demanded to be set up. So constitutionalism to constitution is similar as the relationship of 'rule by law' and system of law. The developing of constitutionalism is not only limited by the system of law but also decided by political arrangement, the structure of society, the quality of citizens and the belief of public. So it' s much easier to make constitution than enforcing constitutionalism.Looking back and concluding the history of movement of constitutionalism of Chinese modern time has its special significance while we are trying to construct a kind of all new and socialist constitutionalism. The article is setting Chinese hundred years of constitutionalism movement at realizing to find out the "historical crux" which influence modern movement of Chinese constitutionalism movement and to reconstruct the China's socialist movement of constitutionalism on the height of the age.The article is divided into three parts:The first part is the historical development of constitutionalism movement in China. Form historical perspective, it clarifies and interprets the historical movement of constitutionalism form the establishment ofconstitution in the late Qing Dynasty to the establishment of the Republic of China. This part sets its aim at realizing the unity and agree of logic of mind and historical movement.In the second part ,the problem of Chinese constitutional movement in modern times lies in "the invalidity of constitutionalism". And its core lies in the double unavailability of economics and culture. On the condition that economical development hasn't achieved it maturity and culture hasn't matched up, on the first hand, serving as tools to strengthen the power, the constitutional institution was transplanted into the politics and life of China; On the other hand, the theory of constitution and the making and running of constitution were not closely related to personal life. Constitutional movement didn't form the cultural awareness on the whole and unfavorable internal and external historical atmosphere thwarted the natural historical course of evolution of Chinese constitutionalism.For the third part is about the figuration of the foundation of the constitutionalism establishment of Chinese socialist. The establishment of Republic of China and socialistic system efficiently dissolved the historical problems affecting the constitutionalism in modern China. What's more important is that ,the marked development of material, intellectual, political civilization laid the unparalleled positive foundation of Chinese socialist constitutional movement in aspect of economics, culture and politics.
