The 24th amendment to the constitution in 2004 is that the state respects and guarantees human rights. The epoch we live in is one moving towards the right whose main melody is to respect and protect the human right. The right of privacy, however, is the connotation of human rights, so it should also attract people's full attention therewith. This treatise discusses the current status of the legal protection of privacy in china, respectively from the standpoints of the legislation of consititution, civil law and relevant judicial interpretation and the judicial practice; It analyzes problems of the legal protection of privacy in our country's judicial practice and finds out the reason for these problems; The third part is a narration of the status of the legal protection of privacy in foreign countries and its enlightenment to our legal protection of privacy; In the end, the treatise puts forward several assumptions on how to improve the legal protection of privacy in china as follows: we should establish the correct concept of privacy at the conscious level and raise the civil consciousness of self-protection; through establishing the protected mode with the civil law as the base, the other legal norms as the assistance and constitutional protection as the backing, we can promote the process of our legal protection of privacy. We should continue to carry on research and exploration propeling the theory of the legal protection of privacy and judicial practice on to develop and progress.
