With the rapid development of network technology,it brings people a new way of life.Meanwhile,the protection of citizens’ privacy rights is also at stake.The 43 rd statistical report on the development of the Internet in China(hereinafter referred to as the report)covers the basic resources for the development of Internet applications,the scale of Internet users and the development of individual applications.The panorama data shows the overall situation of China’s Internet development in 2018.According to the report,56.53 million new Internet users were added in 2018,bringing the total number of Internet users to 829 million.Internet users spent an average of 27.6 hours a week online,0.6 hours more than at the end of 2017.It can be seen from the report that the number of Internet users in China has been surging,and netizens are using the Internet more and more frequently,which is also the result of the Internet network technology.The large number of Internet users makes it easier to access other people’s private information online.For individuals in the network,some people will steal others’ privacy for their own interests and spread it.For service providers in the network,they hold the private information of a large number of users,and resell them to a third party for profit without the consent of users.Once happen afore-mentioned tort fact,the consequence that such as telecommunication bilk,person flesh searches the tort such as behavior to the party that cause cannot measure.With the increasingly rampant illegal activities on the Internet,the cost of infringement is low,and there is a lack of strict laws and regulations to regulate it.The risk of citizens’ privacy being violated is increasing,and the information security under the Internet cannot be guaranteed.The legal protection of network privacy is the subject of this paper.Firstly,starting from the origin of privacy,this paper analyzes the connotation of privacy and network privacy,and at the same time makes an overall introduction to the current situation of network privacy protection in China.This paper mainly analyzes the dilemma of network privacy protection in China from the perspectives of legislation,law enforcement,judicature and industry self-discipline.Through the analysis of thelegal protection of network privacy in foreign countries,the enlightenment to solve the existing problems in China is obtained.At last,some Suggestions on perfecting the protection of network privacy right are put forward.
