| The as a right with Chinese characteristics, has been controversial in the academic community, meanwhile the operation of its legal system encountered problems. Even after the promulgation and implementation of the 2007"Property Law" and the 2010 "Rural Land Contract Disputes Mediation and Arbitration Law", many problems still exist in practice the exercise and protection of the rights . Should these issues in the rapid development of urbanization in China today not resolved, the peasants, in particular land contract migrant workers would face a huge threat to the right. In this paper, based on senior academic, the author combines his own field surveys in rural land with the internship in court, first to analyze the present situation of the right, and then explore the practical problems facing the system, and legislative shortcomings. At last, the author puts forwards policy recommendations on dealing with the problems.
