Chinese National Parks not only have beautiful natural scenery, but also have a rich historical cultural heritage and unique local, national culture and customs. Therefore, their values are not only material wealth of human being, they are a valuable spiritual wealth of human being. Protective legislation about their environment is an important aspect of the construction. However, with the rapid social and economic development, Chinese national parks are facing increasingly serious predatory exploitation, there are so many laws, regulations, rules for protecting of national parks, but there is less force of law, legislation lags behind and other defects, in recent years, with administrative planning missing, disorder management and other serious damage, national parks resources, are losing the original style and historical value, that is extremely unfavorable to protecting and developing the national parks. Therefore, to settle the problem, it is particularly important to make legislation and institutional building for the protection of Chinese national parks.This article will give a systematic discussion by the following five parts.The first part is an introduction, describes the protection legislation status and practice of national parks, shows the reasons for protecting national parks and the background of this research, emphasizes the important values of parks and points out the purpose and significance of this article, and also simply elaborates the written ideas and research methods.The second part is a summary of Chinese national parks. It shows the basic theory (concepts and classifications) of parks, focuses on the difference with nature reserve, forest parks and national parks, highlights the unique value and the significance of national parks.The third part observes the reality of the current situation of the protection of national parks in China and finds out problems about operating mainly in blind, over-exploitation cause the natural destruction and imbalances in the ecosystem, and also observes our current legislative situation, and analyzes the problems, then finds out the three shortcomings in legal protection: the low level of legal effect, the inconsistent between laws and regulations and the lack of orderly management system, then analyzes the developed countries'outstanding experience in legislation in order to seek to provide a reference for our country. The fourth part is about Chinese legislative improvement and system construction. First, it clears the basic principles of protection, and then under the guidance of the principles, perfects legislation from three aspects: the laws and regulations system, management system and the system construction (including ecological compensation system, funding and management system, public participation system).The fifth part is a conclusion, summarizes the whole article.
