Development Trend And Legal Protection Of Administrative Subject

After over three decades of reform and opening up, the material wealth of society has kept increasing rapidly. Social and economic structure has also undergone tremendous changes since then. Gradually, our traditional unitary interest structure has been disappearing and diverse interest structure is taking shape. The research on the development trend of administrative subject under public administration and its legal protection are of great significance for theory construction and social practice for current administration.Administrative subject is an exotic theory. In Administrative Law, administrative subject means: it is an organization established by law which entitled to the national executive power and administrative activities within terms of reference with their own name. While enjoying executive power, it can bear its due independently. In the most western countries, administrative subject includes not only nation and local organ, but private subject bearing the public functions. Individual citizen, as an independent subject, has been recognized in politics. In China, administrative subject can not be individual, but only organization.China's administrative reform has been several times. Although it has made great progress on the administrative functions and administrative thinking, there is no fundamental breakthrough. The main reason is that a link is not formed between the institutional reform and the government function, that it did not combine government reform with legal protection and that it did not conduct supporting reforms timely.Under the influence new public management emphasizing on public service, administrative departments at all levels will put the satisfaction of citizens and public interest on the first place. A growing number of intermediary organizations and the public legal-person will be eligible for the status of administrative subject. Development trend of diverse administrative subject will be presented.In practice, diverse interest pattern has not been fully confirmed by law. The statue of legal protection does not make our government cope with the practical needs of administrative reform, nor can it provide the adequate legal protection for the development of diverse administrative subject. Reliable way to form diverse administrative subject based on decentralization is to improve our system of legal protection, with which to protect China's administrative system reform and promote the diverse administrative subject towards a healthy and rapid development.
