Research On Reproductive Rights Of Special Subject

Birth is a very old topic and the human extremely natural phenomenon. If there is no human birth, it is impossible to have us now and in the future, it is impossible to have human society. Reproductive right is the important content of the family system. In recent years, our country about reproductive right of civil disputes emerged in endlessly, the domestic and foreign legal begin to pay attention to reproductive rights. All kinds of reproductive rights disputes, to a certain extent, exposed the moral and other social mechanism of this domain. The author introduced three special kinds of reproductive rights and presented their views. This paper is divided into four parts, each part of the content as follows:The first part is a summary of the reproductive rights. First discussed the legal nature of reproductive rights and qualified it as public rights personality rights. It is summarized the evolution process of the reproductive rights, and points out that this research object is special subject of reproductive rights. It is introduced about present reproductive rights legislation and research.The second part is the reproductive rights of criminal. There are two different points of view about criminals'reproductive rights, this paper argues that criminals also should enjoy reproductive rights. Prison criminals'personal freedom is restricted as a special group and it is difficult to them to enjoy the rights as other people. In seeking criminals reproductive rights with prison management based on the balance of criminals realize birth selection, conditional, there are differences and purpose protection. The establishment of the criminal reproductive right is not only a national respect and safeguard human rights, but also an important aspect of the rule of law and the idea of progress symbol.The third part is the right of intellectual disabilities. Intellectual disabilities reproductive rights issues faced dilemmas ethical dilemma. People should be responsible to human birth, we can not prove if we deprive the rights of intellectual disabled children. Therefore, in law should confirm that intellectual disabilities enjoys the right to reproduce, but should be punished by reasonable limit. Our country should perfect relevant laws, ensure the rights to protect the vulnerable groups.The fourth part is unmarried female reproductive rights. Our country law never deny the reproductive rights of single women, rights of availability and rights are two problems on different levels , whether should be studied for power footing to right, how to guarantee the realization of this part of people's reproductive rights is not only a legal problem, but also a significant social problems.
