The bearing right is the bearing system’s important content. In recent years, our country has emerged one after another incessantly about the bearing right’s civil dispute, therefore the bearing right question became the important research problem that the dom estic and foreign method educational world have to pay much attention to. Therefore, t he study of the bearing right will not be only benefit the guidance of real life in the r eproductive activities, and also to enrich and expand the rights of citizens theoretical syst em.The author tries to clarify the meaning of birth right from the aspect of basic huma n right through the study of birth right and analyze the property of birth right in the ho pe of proposing legislation on reproductive rights you my views.In my opinion,we must have a clearer understanding of the bearing right in theory. and then we can protect the bearing right effectively. The purpose of this article is base d on the judicial practice to solve the hard problem in the court actual operation,and pr otect the citizen’s bearing right well. Therefore this article obtains from the real case, to explore and research the problem, at last to propose some suggestion and views.
