| The journalistic interview right violated violently or non-violentlyis very popular and becomes a serious judicial problem because of the changeof historical role, the lack of laws and self-discipline. Among differentinfringements, state agencies and their employees encroach the journalisticinterview right, which goes against the essence and aim of Constitution.Power restricts Right, which is more harmful and needs to be regulated.The journalistic interview right which originates from Constitutionis a special social right rather than the public power or private right, it isderived from the freedom of speech,sovereignty of the people, the right ofcriticism and supervision,etc. Improving related law system is meaningful forprotecting journalistic interview right. Based on the Chinese special condition, it is necessary to issue "Press Law" which makes the protection ofjournalistic interview right more practical.It is necessary to conform to the principle of proportionality strictlywhile agencies take actions to restraint journalistic interview right. It is illegalif the actions do not fit to three sub-principles of proportionality totally.Inorder to achieve some administrative aims by sacrificing the journalisticinterview right is not worthy.
