In recent years, confilicts between doctors and patients are on the increase; therefore, how to effectively solute and harmoniously construct the doctor-patient relationship become the hot spot which the people cared about. The causes of intensified doctor-patient relationship can be sum up as follows: owing to the fast developing medical technology, effective exchanges between doctor and patient are lacked; mutual trust is low.Howerer, the most essential element is the absence of systematic, comprehensive and detailed legal provisions. Besides, a complete and effective legal protection system in terms of patient rights and interests has not been formed.How to balance the interests between physicians and patients, namely alleviate their conflicts through consummating the patient rights and interests protection system, but not overburdening the doctor's medicinal prescription duty, plays a key role in the aforesaid problem solving.Nevertheless, though there are rules and regulations concerning with the patient's informed consent right, an integrated patient's right protection system is still needed, based on our current legal system, In practice, due to abstract stipulations, doctor-patient disputes are aggravated instead of solving, even although the patient's informed consent right has its legal basis.Hence, to promote harmonious doctor-patient relationship and advancement of medical services, people shoule get a more clear perspective to the patient's informed consent right and should be well-advised to propose some practical and feasible plans for legislation practices.The innovation of text in the following way:First,analyse the patient's informed consent right between view of the conflict rights, and points out that the necessity of patients right; second is through legislation and practice of the causes defect, analyzes the causes of further provide basis for legislation perfect; third put forward more practical and more comprehensive measures.
