The patients’right of informed consent in disease diagnosis and treatment is a fundamental right of patients.Based on the patients’ informed consent right,patients can be more autonomous in deciding on individual medical measures.Medical activities are high professionalism and strong technicality.The asymmetry of information between doctors and patients has been intensified,and the contradictions between doctors and patients have been more acute.Disputes about the patients’ right of informed consent have increased year by year.Although the number of academic studies on the patients’ informed consent right is considerable,most of the studies are simply protecting the patients’ informed consent’ right and unilaterally emphasizing doctors’ obligation of notification,which is not enough to solve deep problems.The laws and regulations on the patients’ informed consent right in our country are too vague,which will increase the misunderstanding between doctors and patients,and lead to different judgment in the same case injudicial practice.In consideration of the above problems,this article is developed as follows:In the first part,starting from the change of the traditional doctor-patient relationship to the modern society,introducing the connotation and constituent elements of the patients’ informed consent right,and analyze the attributes of the right.It is urgent and necessary for us to study the patients’ right of informed consent.The second part,under the current national conditions,analyzes the dilemma and deficiencies of the right from the legislation and the practical aspect.It focuses on analyzing the content and deficiencies of the medical institution’ s inform consent,to guarantees the exercise of the patients’ right of informed consent.The third part is aiming at the current problems that impede the implementation of the patients’ right of informed consent in China,corresponding solutions are proposed from the perspective of both doctors and patients.
