Research On The Minors' Property Rights In Divorced Families

The minors belong to the social vulnerable groups which is in great number, a special status and complicated situation. In China, it is admitted legislatively that the minors have the equal capacity for civil rights and property rights as adults. However , the minors' existence and development have always been ensured by the ability and property of the adults. In reality, a lot of minors, especially those of divorced family usually have trouble in existence, education or development. By reason of the family or the society, the property rights of the minors have often been violated. As we know, the property rights is the essence of all the civil rights .Taking the property rights of the minors from the divorced families as an argument this dissertation has analyzed the legitimization of the minors' property rights, and emphasized the significance of protecting their property rights. And the dissertation lays much emphasis on the problem how the minors should protect their property rights by themselves. Because of the minors' specific physiological condition, their property rights are always supervised by their guardian. And this dissertation expounds upon the guardians' limits of rights, their liability and supervision to the guardians. Aliment is the main living source for the minors of divorced families, but the existing situation of arrears in aliment raises the problem that the minors' living can not be protected becomes more and more serious. This dissertation has tried to establish the system of the minors' aliment paid once and for all, and has put forward the conception for the payment, use, administration and supervision of the aliment.
