Research On Legal Problems About Credit Supervision Of Market Players

Credit and faithfulness is the lifeline of market, and the condition of credit of market players forms the ring of credit, and the relationship among market players develops the chain of credit. The chain of credit will accelerate the development of market economy. If there is any loss of credibility, the chain of credit may be broken, which will affect the healthy and well-ordered development of the socialist market economy. Market Players' credit includes the credit of money exchanging and the credit of credit exchanging. The healthy development of the credit of the two parties mainly depends on the effective supervision on credit of relevant governmental authorities. From the point of supervision, this thesis uses the method of comparison and analysis to discourses upon the credit construction of money exchange and credit exchange. On the basis of the legislation and execution experience of developed credit exchange countries, such as American, this thesis constructs the mode of supervision of China, which will provide some theoretical basis for the credit construction of Chinese market economy, and use the theory to guide the practice so as to promote Chinese relevant governmental authorities to effectively supervise the credit of China to ensure the healthy and well-ordered development of market economy. In chapter 1, this thesis concretely analyzes the litigation and execution of credit supervision of market economy by relevant governmental authorities to indicate that although there has been great progress of the credit of money exchange, there are still many outstanding problems of credit supervision required to be solved. In chapter 2, this thesis firstly make out that government should strengthen its responsibilities of supervision in credit construction of market economy, the Administration for Industry and Commerce should be the leading party of credit construction in money exchange, and other parties are the assisting parties of the Administration for Industry and Commerce. And this thesis emphasizes on the special function of China Consumers' Association, which is a non-governmental organization. The basis of the united action of the parties is the principle of credit supervision. Based on chapter 1 and chapter 2, chapter 3 tables a series of proposals for perfecting the credit supervision of money exchange of China, and the most important of which is to build the information sharing system. With the effective supervision of credit money exchange market players and the development of credit exchange, the valid supervision of Credit Investigation becomes much important. In chapter 4 and chapter 5, this thesis mainly discourses on the supervision of Credit Investigation in credit exchange. In chapter 4, this thesis firstly analyzes the necessity of supervising the Credit Investigation market. On reference of the characteristic of Credit Investigation system of foreign countries, we can see there are still a lot of outstanding problems of Credit Supervision in system construction and perfection. In accordance with the above-mentioned analysis, in Chapter, this thesis constructs the mode of effective supervision for Credit Investigation. One is to modify and to make laws relating to this field; the other is to make Credit Investigation Bureau as the leading party of credit supervision for Credit Investigation. At the same time, in order to ensure the effective supervision, the relevant governmental authorities should build the system of punishment for the loss of credibility to punish the credit-lost. The relating reformation and construction of credit is also an indispensable part of effective supervision of Credit Investigation market.
