The Relationship Between Administrative Power's Extension And Restriction In Managing Public Health Emergency

From the beginning of several cases of the SARS incident, this article discusses how to create power' s extension , discusses the concept , important composition' s condition , characteristic and main performing bodies of extension' s powers , discusses the conflicts between extension ' s powers and citizen ' s basic rights and also discusses the main principles and specific ways of extension' s powers ' restriction in coping with the public health emergency (PHE). The essay is of the opinion that : â‘ extension' s powers must be appropriately limited .In case extension' s powers are limited too much , it is disadvantageous that main performing bodies of extension' s powers adopt timely and effective measures to control serious damages brought by PHE; â‘¡citizen's basic rights are not absolute in the PHE. Power ' s extensions have an expense produced by restraint of citizen' s basic rights. But some citizen' s basic rights are not restrained; â‘¢the purpose of power' s extensions is firstly to maintain public benefits of society so as to eliminate rapidly the disadvantageous consequence brought by PHE and ensure citizen' s basic rights to be better come true with more deeply meaning.
