The Research On Right To Know Under The Vision Of Supervision Over The Use Of Power

Since Sweden developed"the Freedom of Information Act"in 1766 and Kent Cooper first proposed the concept of the right to know in 1945 , the right to know has been to invoke a broad and international influence. This right which under the vision of supervision over the use of power, mainly refers to the area of public law, to emphasize that citizens have the right to gain the official information and the related supervision. Citizen's right to know is the basic right of modern citizens, but also the prerequisite and foundation to achieve other citizen's rights. The dynamic balance between power and right, is not only the theoretical basis to research the right to know, but also tell us the right to know is the starting point of the supervision.Protection on the citizen's right to know can enable citizens to keep abreast of government information to ensure that basic political rights of citizens, at the same time, it is able to identify and correct the major fault and errors during the course of government management. Protection on the citizen's right to know can help to curb corruption and is conducive to the free flow of information, to restrict the executive powers of government officials, to ensure fair competition in a market economy.China is at the time of economic transition and at a high rate of the community's contradiction. Protection on the citizen's right to know is not only conducive to regulate the authority of government, to strengthen the government's ability to govern according to law, to monitor and prevent the abusing of government power ,but also to promote the building of our government's credibility. More practically, protection on the citizen's right to know is a new way to resolve social contradictions, to solve development problems and maintain social stability.In particular, protecting our citizen's right need to change the concept of the right to know, to improve the legislative, judicial protection, administrative reform and so on. We should make efforts to create the atmosphere the country attaches great importance to the protection of right to know; to construct reasonable mechanism to protect the citizen's right to know; to improve the legislation on the protection of the right to know continuously; to increase the public transparency of Government's administrative supervision. Although China's right to know legislation and the system of construction has just started, we believe that with the deepening of reform, the improving of democracy, the strengthening of people's rights and government's the sense of service, the protection on citizen's right to know will also be further improved and developed.
