Probing Into The State-owned Shares Right Supervision Under The Condition Of Diversity Property Right

Based on the principl guideline of the policy about deepening innovation of the manage system upon state property made on the 16th Central Committee of Communist Party of China and The Third Plenary Session of it, and combined with the practice of state property reforming in China, this thesis analyses both the current situation and the cause of the bug of the State-owned shares right supervision. From not only theories but also practice of the right supervisor, this thesis makes a researching on how to adapt to the development of the Market Economy system, to establish and strengthen an effective supervision system. And it Especially discusses the premise and fundamental of the State-owned shares right supervision under the condition of diversity property, and it then demonstrates the rationality of the following parts: one is state property management, supervising and management system which takes property right management as the main thread, with authorized operation as the character and constructed by a three-class main body that is State-owned property management council; asset management companies; exclusively invested, proprietary and share companies. The other is the on-going supervision mode coming from the main cognitions which presented by the mode of three-class main construction and ambipolar consigning agency. At the same time, this paper tried to go deeply into build a state property supervision system target mode in principle, then at the end of this article the writer made 6 subsections to design the feasible ways on how to set up the unique management institutions on state property objectively.This paper is composed of 6 chapters and 17 sections. The 1st and 2nd chapters introduce the topic of this thesis. The 3^rd and 4^th chapters refer to the analysis of some related theories, and the 5^th and 6^th chapters deduce the conclusion then give some suggestion about some cases.
