Nowadays, although there is a tendency of strengthening study on the criminal law functions of protecting human rights in the theoretical circle, the study on the due professional conducts remains to be comparatively weak. Not much progress has been made not only in the studies on the concept and kind of the due professional conducts but also in the study on justified basis, value and standards. However, the social practice is developing so quickly and manners in the professional fields is so changeably complicated that it is very hard to make a right judgement over qualities of these manners. Therefore, it becomes a urgent project to strengthen the theoretical study of the due professional conducts. Divided into three, the paper presents tentative analysis on the theory of the due professional conducts, through basic principles of law study.The first part presents not only a deep analysis about law characters, action characters and norm elements of due professional conducts but also gives a reasonable and scientific definition to the connotative concept of due professional conducts after comparison with and reference to others. Meanwhile, the author analyses the kinds of due professional conducts and the field where it takes place. He also makes a comparison between due professional conducts and due conducts concerned.In the main body of the paper, the author focuses his attentions on the basis of formalization of due professional conducts. He thinks though due professional conducts have the same grounds like other due conducts, they have their special grounds. Besides, this part furthers the discussion about the three values of due professional conducts, that is, value of human rights, value of justice and value of freedom.In the third part, the author analyses the researching significances and present conditions of the establishing elements of due professional...
