Research On Legalization Of Power Morals

It is people's distrust that leads to the legalization of power morals, which is, in essence, a course of transition from traditional type of political authority and Chrisma political authority type to the legal political authority type. Western countries has left us far behind them in the construction of rule-by-law society by the way of the legalization of power morals . For historical reasons, the legalization of power morals in China is developing relatively slowly, and exactly speaking, the legalization of power morals began only after Deng Xiaoping' s idea of rule-by-law was adopted. From then on, the legalization of power morals has become a basic fact as well as a basic trend of the current political society of China and also an important content and component part of China's political civilization construction, legal construction and construction of socialist morals as well. China's peculiar political historical tradition makes it possible for the legalization of power morals to acquire great significance, and many problems to be solved result therefrom. This dissertation attempts to probe into the problems concerning the legalization of the power morals, in hope of deepening the research on this topic. The text consists of four parts as follows:Definitions of such key concepts as power, moral, power morals, legalization of morals, legalization of power morals come first, and meanwhile, the origin of legalization of power morals is traced back. Firstly the author reviews some different definitions of different theorists about power.the author believes that moral is some kind of virtue guiding people's activities to be carried on in their life; Power moral is the combination of the notions, norms and behavioral practices ofmorals related to the operation of power, which includes public or political morals and private morals; The legalization of morals is a process or activity which converts some universal and comnwriy-accepted moral principles or moral obligations into mandatory or advocatory legal norms or legal principles ; The legalization of power morals is a process or activity which legalizes the notions, norms and behavioral practices of morals related to the operation of power and provides for the legal consequences if violated.Secondly the author has reviewed the history of legalization of power morals in ancient China ,current China and in western society as well, especially the legalization of power morals in western and Chinese society, with a full review of the history and reality of advanced capitalist country such as UK and USA and of China. This chapter aims at illustrating1his truth: moral, especially power morals are unbelievable, and they must be checked with effective legal measures to prevent them from doing harm to society through abuse of power.Thirdly the author has established the notion that the legalization of power morals is feasible, through the analasis of the possibility, reality and necessity of the legalization of power morals.Fourthly the author comes to reflexing, assessing and analyzing China's legalization of power morals, which analyzes the characteristics of legalization of power morals in China, the ways to and the significance of legalization of power morals as well as issues to be paid attention to.
