A Study On The Definitions Of Multimodal Transport And MTO

international multimodal transport is more and more important to the development of economy, but there is no an effective Convention governing multimodal transport since her appearing because the UN Convention on International Multimodal Transport and the UNCTAD/ICC Regulations on Multimodal Transport did not come into force, which impeded her from developing. There are simple provisions for multimodal transport in China Maritime Code and Contract Law that cannot satisfy the need of development so as that more amendments have to be done.The development of economy requires the perfection of the complicate system of multimodal transport. The concept of multimodal transport and multimodal transport operator(hereafter as MTO) become the topic of this article with consideration that it is the basic part of the legal system on multimodal transport whose definitions are important to the perfection of multimodal transport system. Based on the current provisions of Convention and laws and the performances of scholar, the article analyzes detailed the concept and character of multimodal transport and MTO and pointed out accordingly the problems in this respect and further gave my advise of amendment. At the same time, the article makes clear the difference between them and the relative terms by comparison. It is clear that the advance in this respect must cause more and more legal problems, so the article wish to contribute to the relative study and development on this subject.
