The Studies On WTO Safeguard Measures

Safeguard measures, like the anti-dumpling and anti-subsidy measures, belong to one of the trade remedy measures of WTO. But the safeguard measures belong to the normal trade behavior, the anti-dumpling and anti-subsidy measures are the unfair trade behaviors, it protects the low-level, high-cost, ill-managed and non-competitive industries, and to get the chance for adjustment. But for a long time that the WTO members put much attentions to the anti-dumpling and anti-subsidy measures, unfamiliar with the safeguard measures. Nowadays it becomes an important measure, more and more countries use the safeguard measures to protect the national industries.China is a developing country, after China's entrance into the WTO, the tariff will become lower and lower, the possibilities of the competitive foreign products will become higher and higher. So it is very necessary to make use of the safeguard measures to protect the national less competitive products. China shall protect its right interests through the disputes settling system, resist other countries that misuse the safeguard measures, actively sue or counterclaim to protect the trading system. So how to properly face the challenge of the trading system, we should have a further study of the safeguard measures. This article focuses on the study of the implementation measures of the safeguard measures and aims to mostly protect the just right and maintain the economic safety in the multi-lateral trading system.In the first and second part of the article, it aims to explain the basic theory and the implementation measures of the safeguard measures; it includes the definition ofthe safeguard measures, the political and economical analysis of the safeguard measures, the character of the safeguard measures etc. In the third and forth part of the article, it introduces the content and the implementation measures of the safeguard measures in detail, including the substance, procedure and other regulations, such as the implementation conditions of the safeguard measures, the emergency safeguard measures, the transitional safeguard measures, the special safeguard measures etc. In the fifth part, it focuses on the improvement of the safeguard measures, the legislation of China's safeguard measures and the strategy to make use of the safeguard measures.
