Research On Product Defect

The definition of product defect is the core of modern product liability, as under the system of strict liability ,the producer and seller will assume the liability of compensation without considering whether there is a fault on them if consumer can prove: 1)there is a defect in the charged product;2)occurrence of certain damage;3)the defect is the cause of the damage.Based on this,this article tries to research into the theory by comparing the related laws of China and foreign countries.There are five parts in this paper: the first part is mainly on the analysis of basic concepts of product defect;the second part is the classification of product defect;the third part is mainly on how to define product defect;the fourth part is on the defenses of product defect;the fifth part is on the consideration of how to improve the system of product defect in China.
